Act 1 Disclosure

ACT 1 DEBT SERVICE EXCEPTION MANAGEMENT

Governor Rendell signed Special Session Act 1 of 2006, the Taxpayer Relief Act (the “Act”), on June 27, 2006.  This law will ease the financial burden of home ownership by providing school districts the means to lower property taxes to homeowners via the funding provided by gaming revenues.  The Act, however has added additional burden on the school district's administration. 

One of the burdens is filing annual debt service exceptions on previously funded projects.  The Pennsylvania Department of Education (“PDE”) is requiring certain documents annually while filing with the Referendum Exception System.  This information includes:

  1. Debt Service Schedules (to be updated annually)
  2. Signed Bond Resolutions authorizing the debt
  3. Closing Statement for the bond issue
  4. Bond Resolutions of bonds that were refunded

PDE is requiring this information in email form to be sent as pdf attachments to the general mailbox.  Two problems that may occur are many of these documents are rather large and the school district’s email servers do not have enough storage to send these documents in an efficient manner.  Second, the process of gathering this information is tedious and time consuming.  The school district may not have enough staff to manage this process.  PDE will not store this information on their servers so the school districts must provide the information annually.  Concord could be retained to gather the information, store it and provide customized annual emails to PDE using hyperlinks complete the process.  Concord will also track that the email has been opened and follow-up to make sure PDE received all the information required.  Additionally, Concord can also complete and review the calculations of exceptions as well.
